Who we are and whom these terms cover

The provider of the services is:

These terms govern the relationship between us and a client who orders a website or e-shop build, further modules or operation from us. Anything we agree differently in a specific contract or in the approved brief takes precedence over these terms.

We provide our services to businesses only — to entrepreneurs and legal entities acting in the course of their business. Relationships with businesses are governed by the Slovak Commercial Code (Act No. 513/1991 Coll.).

What we deliver

We build business websites and e-shops on our own Vera platform in three classes: Iskra, Lúč and Spektrum. The classes differ in scope — how many Vera modules are switched on — not in quality. What each class includes is set out in the price list, valid from 1 September 2026:

Modules beyond your chosen class (a custom design or an extra language, for example) have a price and a number of days in the price list and are agreed with you in advance.

A separate service is operation and hosting at 30 € a month (see Operation and hosting).

We do not do logos or photography in-house; we write the site copy ourselves, and a business website covers content for up to six pages.

How the contract is formed

1. Enquiry. You write to us through the contact form, by e-mail or by phone. We reply within 24 hours. Neither the enquiry nor the quote commits you to anything.
2. The brief. Half an hour on the phone or in person: who you sell to, what a visitor should do on your site, what irritates you about the current one.
3. Written brief. The conversation becomes a written brief with scope, price and timeline, sent to you for approval. That brief is what gets built.
4. Preview. Within five days you see one to three finished screens with your logo and copy. You send your notes in one go, in the single round included in the price.
5. Sign-off. We carry on only once you approve the preview. Until then you pay nothing; if you do not approve it, the cooperation can end without any payment.

The contract is concluded: when both parties sign the contract and a non-disclosure agreement (NDA).

Price and payment

• Prices are final. We are not VAT registered, so the figure in the price list and in the brief is also the figure on the invoice.
• The price of the build is a one-off payment. The only recurring payment is operation.
• Whatever is agreed before the contract is concluded is what the invoice says; nothing is added at handover.
• Work beyond the brief — another round of revisions, a new feature — is done only once we have agreed its price in advance.
• You pay for the domain directly to the registrar, so that it stays in your name; it is not part of our price.
• Payment terms: the preview is free. Once you approve it, we sign the contract and the NDA and issue the first invoice. <strong>Website:</strong> a 50 % deposit when the contract is signed and 50 % at launch. <strong>E-shop:</strong> 40 % when the contract is signed, 30 % once the design of the main pages is approved, 20 % at launch and 10 % after the 30-day acceptance period. Invoices are due within 7 days of issue and are paid by bank transfer.
• Late-payment interest: at the statutory rate under the Slovak Commercial Code and Government Regulation No. 21/2013 Coll.

Timelines

The delivery time is listed in the price list for each class (see the table under What we deliver), and each extra module adds its own number of days, so you know the launch date in advance.

The time is counted in working days from the moment we have all your materials and the approved preview, not from signature. If materials or answers are late, the deadline moves by the same amount.

What we need from you

• Your logo if you have one, a handful of photos and answers to five questions — by form or in half an hour on the phone.
• Reading and signing off the copy we write. If you have your own, send it and we both save a round.
• Sending your notes on the preview in one go, in one round.
• Staying reachable for the occasional short question during the build.
• Access to the domain so that we can point it at launch.

You are responsible for the materials you give us (copy, photos, logos): you must have the right to use them and they must not infringe anyone else's rights.

Handover and launch

At launch we point the domain, switch on the SSL certificate, traffic measurement and the sitemap for search engines, and take the site live. You receive your Vera admin credentials and a two-hour training session, included in every class. We do not put half-finished sites online.

Launch constitutes handover of the work. From that day the 30-day period for reporting faults runs (see Faults and liability).

Who owns what

• Your data and content are yours. We export products, orders, copy and photos for you at any time in standard formats.
• The domain is yours — registered in your name from the start.
• The Vera platform is ours. Your site runs on Vera, but its code and further development remain the property of LUMA and are not sold with the site.
• Site design and code: when you leave, we hand the site over as a content export — copy, images, products and other data in standard formats. The site code and templates that run on Vera are not handed over.

Operation and hosting

Operation costs 30 € a month and is the only recurring item. It is not an instalment on the site, which is paid for once. It includes:

• Hosting on LUMA Creative servers (Websupport.sk)
• SSL certificate, renewals included
• Automated off-site backups
• Uptime monitoring, with an alert when the site goes down
• Ongoing updates to the Vera platform

Vera updates go out to all clients at once. Operation has no minimum term: you can end it at the close of any month, and when you leave we export your data for you.

• Invoicing of operation: monthly in advance, starting with the month in which the site goes live. If a promotion on operation applies (for example the first 6 months free), we invoice from the first month after it ends; current promotions are shown on the website and in the quote.
• How to end operation: by e-mail to peter.kapusnik@lumacreative.online at any time, without giving a reason and with no lock-in. Operation ends on the last day of the calendar month in which we receive the notice.

Where operating your site involves processing your customers' personal data (orders or enquiries from your site, for example), we do so as your processor under Art. 28 GDPR and will sign a data processing agreement with you.

Faults, complaints and liability

• Faults reported within 30 days of launch are fixed at no extra charge. After that, the hours worked are billed: 40 € per hour. The amount is final, no VAT is added.
• A fault means something does not do what it was built to do under the brief. A new feature is a separate order.
• Report a fault by e-mail to peter.kapusnik@lumacreative.online or by phone; you write straight to the person who built your site.
• We do not guarantee a particular speed score or load time: part of the result depends on third-party scripts and on content you add to the site later.
• You are responsible for the content you put on the site and for its compliance with the law.
• Limitation of liability: total liability for damage is limited to the price of the order in which the damage arose. The limit does not apply to damage caused intentionally or through gross negligence.

Governing law and disputes

The contract and these terms are governed by the law of the Slovak Republic. We first try to settle any dispute by agreement — most are resolved with one phone call. Failing that, the competent court of the Slovak Republic decides.

Final provisions

We may amend these terms. A contract is governed by the version in force on the day it was concluded; a change affects operation only after we have notified you in advance, and if you disagree you can end operation without penalty.

Should any provision be invalid, the rest remain in force.
